1. About these terms
These terms apply when you download or use the PADS app or visit pads-app.com. PADS is provided by [Company legal name], a company registered in [England and Wales] under company number [number], with its registered office at [registered address] (“we”, “us”).
By using PADS you agree to these terms, our Privacy policy and our Acceptable use policy. If you don’t agree, please don’t use PADS.
PADS is available only from pads-app.com. Copies from anywhere else may have been changed, and we can’t support them. Installing PADS means allowing your phone to install an app from outside an app store; the Download page explains how.
2. Who can use PADS
You must be [16] or over to use PADS. By using it, you confirm that you are. You may only have one personal account, and you must give accurate details when you create it.
3. What PADS is
PADS is a private companion for steadying yourself and planning through big changes in life. It helps you check in, choose a few things to do, keep Life in View across Wellbeing, Home, Livelihood, Character and Community, and share what you choose with a mentor you trust.
PADS offers tools and prompts. The choices you make, and what you do with them, are yours.
4. Not an emergency or medical service
PADS is not an emergency service and is not monitored. It does not provide medical care, diagnosis, therapy or counselling, and it is not a substitute for professional help.
If you or someone else is in immediate danger, call 999 in the UK, 000 in Australia, or your local emergency number. If you are struggling, please speak to your doctor or a support service. The Talk button helps you reach people you trust; it does not alert anyone automatically.
5. Not financial, legal or professional advice
Some PADS tools, such as Money picture, help you write down and look at your own situation. They do not give financial, investment, debt, tax, legal or other professional advice, and they do not recommend products. Nothing in PADS should be relied on as advice. For decisions about money, debt, benefits or legal matters, please speak to a qualified adviser or a free advice service.
6. Your account and recovery phrase
You are responsible for keeping your phone, PIN and recovery phrase safe. Your data is encrypted with keys that only you hold. This means we cannot read your data and cannot recover it if you lose your recovery phrase and your phone. We will never ask you for your recovery phrase.
Tell us at [[email protected]] if you think someone else has accessed your account.
7. Your content
Everything you write in PADS belongs to you. You give us only the permission we need to store and transfer your encrypted content so the features you use (backup, sync and sharing) can work. We cannot read it and we do not use it for any other purpose.
You can export or delete your content in the app, and you can delete your account at any time.
8. Mentors and sharing
You decide what to share with a mentor, and you can change or stop sharing at any time. Mentors are people you choose, such as a friend, relative or someone from a group you belong to. They are not provided, checked or supervised by us, and they are not acting for us.
If you act as a mentor, you agree to keep what is shared with you private, to respond with care, and to follow our Acceptable use policy. A mentor is not a replacement for professional or emergency help, and you should encourage the person you support to seek it when needed.
9. Other apps and services
Some features open other apps, such as WhatsApp, Signal or your phone, or link to other websites. Those apps and sites are run by others under their own terms and privacy policies. We are not responsible for them.
10. Using PADS responsibly
You agree to use PADS lawfully and in line with our Acceptable use policy. In particular, you must not use PADS to harm, harass or deceive anyone, share content you have no right to share, or try to break, copy or interfere with the app or our systems.
11. Price, availability and changes
PADS is currently free, with no adverts and no in-app purchases. If we ever introduce paid features, we will tell you clearly in advance and you will never be charged without agreeing first.
We work to keep PADS available and secure, but we cannot promise it will always be uninterrupted or free of errors. We may update PADS to improve it, fix problems or meet legal requirements. Some updates may be needed to keep using the app.
12. Our intellectual property
The PADS app, the PADS name and logo, Life in View, and the design, text and software of the app and website are owned by [Company legal name] or our licensors. We give you a personal, non-transferable licence to use the app for your own, non-commercial purposes. You must not copy, modify, sell or reverse-engineer it, except where the law allows you to.
13. Ending your use
You can stop using PADS at any time and delete your account in the app. We may suspend or close an account if it is used in serious or repeated breach of these terms or the Acceptable use policy, or if we must do so by law. Where it is safe and lawful, we will tell you why and give you a chance to export your data. If we ever decide to stop providing PADS, we will give you at least [60 days’] notice.
14. Our responsibility to you
We will provide PADS with reasonable care and skill. We are not responsible for loss or damage that was not foreseeable, that was caused by something outside our reasonable control, or that results from you losing your recovery phrase. Because PADS is a free personal service, we are not responsible for business losses.
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
15. Your consumer rights
Nothing in these terms affects your legal rights as a consumer. If you live in Australia, you have rights under the Australian Consumer Law that cannot be excluded, and these terms do not exclude them. [Lawyer to confirm wording for each market where PADS is offered.]
16. Law and disputes
These terms are governed by the law of [England and Wales]. If you have a concern, please contact us first so we can try to resolve it. You may bring a claim in the courts of the country where you live.
